BOOKING FEE / SESSION FEE

Booking fees taken for any session or assignment (Newborn, Parents, Siblings and First Birthday portraits, are non-refundable except in the event PTB cancels the booking or at the discretion of PTB. in certain unavoidable circumstances, however full disclosure of circumstances will need to be provided. Plum Tree Baby will however, transfer your booking fee to a new date, agreed by both parties within a six week window from the original date. Please bare in mind, missed Newborn sessions may have to become Little Sitter sessions to achieve the best portrait results. Any no shows without contact, will lose their booking fee, as it will not be transferrable.

SICKNESS

We understand that children can be unpredictable and fall ill at any time. In the event of sickness prior to the session, the Client agrees to make every possible effort to inform Plum Tree Baby Photography no later than 3 hours prior to the start time of the photography session. The session can be transferred to a new date which will be at the convenience of both parties within a maximum six week period. PTB Photography, reserves the right to re-schedule outside of this time limit due to any existing commitments. If the Client fails to reschedule within the 6 week time period, PTB Photography has the right to cancel the booking with all payments made nonrefundable. In the event of the child falling ill during the session, PTB Photography reserves the right to postpone the photo shoot and re-schedule at the convenience of both parties.

FULFILMENT OF OBLIGATIONS

1. PTB shall not be liable to the client for any failure, in whole or in part, to fulfil its obligations where failure arises as a result of an event or circumstances beyond its control, which may include, (but are not limited to) equipment failure, inclement weather, illness or injury. PTB will agree another date for a new session if this should happen.
2. The Client understands and accepts that the photographic coverage will be as PTB’s professionalexpertise determines. Special requests are not binding, although every effort is made to comply with The Clients wishes.

PRINTS

1. All images supplied by PTB are done on a fully calibrated monitor and all prints will be a true reflection of the editing carried out by PTB. PTB will not be held responsible for variations in images caused by client viewing images on non-calibrated screens or monitors.
2. All prices are subject to change without notice by PTB, but this will not affect existing orders or bookin
3. Extra images over and above package prices will be charged at £25 per image or 5 images for £100, this will cover extra editing and admin time.

DELIVERY

All high-resolution images will be delivered via a download link to the Client within 2-4 weeks of the session date. Delivery folio boxes or any other additional orders may vary and will be advised at time of booking/when final images have been delivered.

IMAGE PRODUCTION AND HANDLING

Save as otherwise agreed between The Client and PTB, PTB shall be entitled to use it’s judgement regarding the style and the artistic input in the production of pictures. This includes, but is not limited to, locations, poses and number of images taken. Due to the willingness of subjects it may not be possible to capture all the pictures requested, or images to The Clients’ full expectations. In the event of un-co-operative children at a session of any kind, for any reason, PTB may not be able to capture any, or all the images that The Client may have requested or expected. The Client is responsible for all children at all sessions and any breakages must be paid for in full.

IDENTIFICATION

While PTB has taken reasonable care to correctly identify, caption and orientate the pictures it does not accept any liability for loss or damage incurred by The Client or any third party caused by errors.

RECEIPT OF PICTURES

The pictures/USB are presumed to have been received in good condition unless The Client notifies PTB in writing of any discrepancy or error within 7 days of receipt.

RETURNS POLICY

1. Incorrectly supplied and items of poor quality can be returned and will be replaced at no extra cost to the Client.
2. Returns will not be considered for incorrectly ordered items or items ordered in error.
3. No return exchange or refund is available on any image once the image proof has been approved and an order placed.

MODEL RELEASE

The copyright of all photographs is owned by Plum Tree Baby Photography. We, the client, give permission to PTB to use any image of our photo session for any general marketing and advertising purposes for Plum Tree Baby. Plum Tree Baby Photography is entitled to use images produced for eg. exhibitions, editorials, digital and print marketing incl. social media platforms, publications, educational DVDs and websites, and/or display purposes. Any images used, will be anonymous and discreet.

CAMERA POLICY

Cameras, camera phones, camcorders or any other recording equipment is NOT permitted during any session, either in the studio, or on location, without the express permission of PTB.

PRIVACY POLICY

1. PTB will never share, or allow to be accessed, shared or distributed, any personal or contact information of any client or enquiry obtained by any means. ALL contact information is protected on secure systems and is password protected at all times.
2. PTB will only keep copies of photographs for a period of 3 months. It is the responsibility of the Client to backup their photographs if a digital option has been purchased.

ALLERGIC REACTIONS

PTB accepts no responsibility for reactions to foods/drinks consumed on the premises. Every effort is taken to inform the Client of food items offered.

COVID-19 additional terms and Conditions.

Term 1

I knowingly and willingly consent to a photography session with Louise Cufley from Plum Tree Baby Photograph.

Term 2

I understand that the COVID-19 virus has a long incubation period during which, carriers of the virus may not show signs or symptoms and still be contagious. I understand that Plum Tree Baby Photography will take all precautions suggested regarding COVID-19 prevention, but it is impossible to determine who has it and who has not given the limitations in virus testing.

Term 3

I understand that should I be diagnosed with COVID-19 positive within 14 days before/following my session, I will contact Plum Tree Baby Photography to let Louise Cufley know of my positive diagnosis.

Term 4

I release Plum Tree Baby Photography for any and all liability associated with receiving a COVID-19 positive diagnosis following our session.

Term 5

I confirm that no member of my family is experiencing any of the following symptoms associated with COVID-19: fever, shortness of breath, dry cough, runny nose, soar throat or loss of taste or smell. If any of my family are, I will contact Plum Tree Baby Photography immediately to reschedule.

Term 6

My session will be cancelled if I turn up to my session with a Covid-19 related illness or symptoms. I understand that my booking fee will not be refunded under these circumstances.

Term 7

If my session is rescheduled, I understand that my booking fee will not be refunded, but will be transferred to the new date.

You will be asked to sign this contract on the day of your appointment before the session starts.

Failure to do so will cancel the appointment.
